Before you enrol or employ foreign students or workers, remember that you will need a sponsor licence. A sponsor licence is the UK visa and immigration authority that you need to sponsor non-UK students or staff in the UK. The licence is valid for four years unless it is revoked by the Home Office, and you must renew it before expiration. For a UK business or educational institution to be considered for a sponsor licence, it must be able to prove the following:
- Your business/institution is legally operating in the UK
- You have taken the resident job market test and cannot recruit from the resident market
- There are adequate systems to monitor funded employees/students
- You provide real jobs with appropriate salaries or teaching
- You have no history of rejected funding applications
Before applying for a sponsor licence, review your organization’s policies, practices, and documents to ensure they comply with regulations.
Sponsor Licence
If you want to hire workers who are not British citizens, you must first apply for a Sponsor Licence. Once the permit is obtained, you will be able to facilitate the visa application of your employees or students.
This will allow them to live and work legally in the UK. Organizations and educational institutions have a variety of options, including:
- Skilled Worker – Suitable for positions on the shortage list of occupations or positions for which there are no talents available in the UK market.
- Intra-company transfer: Applicable to companies that operate in multiple countries/regions and need to transfer their employees to the UK for a specific time or as part of a postgraduate training program.
- T2 Minister of Religion-for people who come to the UK to work for religious organizations.
- Athlete T2-for athletes and coaches seeking top roles in their sport
Sponsor licence for students and/or children
If your educational institution wishes to enrol non-UK students, a sponsor licence is required. To facilitate your visa application, the agency must provide study courses for full-time students in the UK.
As a sponsor of students you are required to:
- Ensure that students attend their courses
- Monitor students for unauthorized absence
- If students leave the course before the course is completed, communicate the date with the authorities
Educational institutions that do not comply with their duties will be investigated by the Home Office, which may take compliance measures based on the nature of the non-compliance.
Apply for a Sponsor Licence
Once it is determined that you are eligible for a Sponsor Licence, ensure that you meet the Home Office requirements at every step.
The process includes:
- Apply for the correct type of sponsor licence
- Identify the right person in your company/organization to manage the sponsorship
- Organize the supporting documents for your sponsor licence application
- Complete the sponsor licence application form and ensure you pay the correct fees
Regarding civil penalties
If you are found to be employing migrant workers without a warranty licence, you may face penalties and irreparable damage to your reputation.
The penalties include:
- up to five years in prison;
- fines of up to £ 20,000 for each illegal worker.
Some proactive planning and preparation is all you need if you want to avoid these penalties.
